TERMS OF USE

Before using the TNH HEALTH Health platform, it is important that you read, understand and agree to these terms.
You are about to make use of the TNH HEALTH application and web portal, which is operated by TNH Digital Health S / A, a limited liability company registered with CNPJ / MF under number [18.669.595 / 0001-38], headquartered in the city from São Paulo, State of São Paulo, to Rua Aspicuelta, 153, Bairro Vila Madalena, CEP 05.433-010 ("TNH HEALTH"). These Terms of Use regulate the use of the services provided ("Services"), pursuant to Law 12.965 / 2014 (Marco Civil da Internet) and Decree 8.771 / 2016. By interacting with the platform you agree and express your free, conscious and informed will to comply with and be governed by these Terms of Use.
TNH HEALTH may change the Terms of Use at any time, but you will always be notified before they come into effect and new consent will be asked for you to continue to have access to the application and our Services.
TNH HEALTH is a multimedia communication platform specializing in intelligence, strategies, programming, software, algorithms, webchats and systems for digital health services.
When using any of our Services, you are bound by the Terms of this agreement, agreeing with what is written and mainly consenting to the access, collection, use, storage, treatment and protection techniques to your information for the full execution of the functionalities offered by the TNH HEALTH.
Use of Our Services
By accepting these Terms of Use, you represent and warrant that the information provided is true, and that you have full capabilities to enter into contracts with third parties. You must be over the age of 18 and, if you are acting on behalf of a legal entity, you declare that you have the appropriate powers of representation to enter into contracts and accept these Terms of Use. Our services will be provided directly to participants or through a Contract Service Provision of Mobile Health Monitoring Programs, signed between TNH HEALTH and a third party (Contractor).
Restrictions. Whether as a participant ("Participant") or medical professional ("Professional"), you declare that you will not:
  • Participate in any activity related to TNH HEALTH that is illegal, harmful, offensive, obscene, violent, threatening, coercive, abusive or in any way questionable by TNH HEALTH;
  • Collect any type of information from the Services other than for the purposes for which they are intended;
  • Interfere with the operation of the Service or tamper with any security measures that we have installed;
  • Violating our Intellectual Property;
  • Provide medical data and other untrue or inconsistent information about you;
  • Provide information and hire services without having the authority to do so;
  • Post or transmit, or cause any communication or request designed to obtain passwords, accounts or private information from any TNH HEALTH user to be posted or transmitted;
  • Modify, translate or otherwise create derivative works from any part of the Site or Services;
  • Decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms from any part of any Services, except to the extent applicable laws specifically prohibiting this restriction;
  • Take any measure that imposes or may impose (as determined by TNH HEALTH in its sole discretion) a large unreasonable or disproportionate charge, attack or break the infrastructure of TNH HEALTH (or its suppliers);
  • Interfere or attempt to interfere in any way with the appropriate work of TNH HEALTH, access or use of the platform;
  • Use manual or automatic software, devices or other processes to invade our platform;
  • Attempt to remove or obtain any content from our platform, or;
  • Otherwise, take any action in violation of TNH HEALTH guidelines and policies.
Ownership. Ownership and rights in our system and its content are solely and exclusively of TNH HEALTH. They are protected by national law and will in no way be transferred to you.
Availability and Termination of Services. Ideally, our Services will always be at your disposal, but we reserve the right to suspend or make the Services totally or partially unavailable to a specific user or all at the same time, at any time and for any reason, without prior notice and without us being able to be guilty of that. We intend to notify you in advance so that you can take the necessary precautions, but we cannot guarantee that this will happen.
Third Party Applications Considering that we use third party applications for the operation of the Services, such as connection servers, digital file storage, among others ("Third Party Applications"), the respective contracts and Terms of Use for the Applications of The 3rd. You agree to exempt us from any liability for anything that has occurred as a result of the unavailability or failure of these services. We do not guarantee 100% availability of the Services, although we employ the best practices and have a committed team to achieve this goal.
Intellectual property
Our Use License for you. TNH HEALTH grants you a personal, worldwide, non-exclusive, non-transferable, royalty-free license to use the Site and content provided by TNH HEALTH as part of the Services. This license has the sole purpose of allowing you to view, use and interact with our Services on your computer, tablet, cell phone or smartphone in the best possible way.
Our Intellectual Property. You may not copy, modify, distribute, sell or rent any part of our Services or the included software, nor may you reverse engineer or attempt to extract the source code of that software, except where the law prohibits such restrictions, or when you have our written permission. The use of our Services does not transfer our intellectual property rights to you. This means that you cannot use content from our Services unless you obtain authorization from the owner to do so. You may not use our brands or logos, or remove, hide or alter any legal notices displayed on our Services.
Marketing Communication. TNH HEALTH has service announcements, administrative messages and other information to send you, in addition, your contact may be forwarded to offer ancillary or equivalent services. If you do not agree with the forwarding of your contact, send the word STOP by text message. You can also cancel your decision to receive emails at any time by clicking on the unsubscribe link located at the bottom of the emails you receive.
Notifications. Our Services can send you notifications if you authorize it. These notifications include pop-ups and messages.
Restriction of rights. Any rights that are not expressly granted to you are reserved by TNH HEALTH. No other rights or licenses are to be inferred, deducted or claimed. Any form of use of these Services that has not been authorized is prohibited.

Your Privacy
Privacy policy. TNH HEALTH's Privacy Policy explains how we treat your personal data and protect your privacy. To use our Services, you must also read and agree to it.
Personal data. By accepting our Terms of Use, we understand that you have given your free and informed consent to the way in which we obtain, store and care for your personal data. When you interact with TNH's automated messages, we may collect information from you, which includes, but is not limited to, your name, address, social security number (or other document number), telephone and e-mail. It is not mandatory that you provide the personal information we ask for, but without this data, in many cases, we will not be able to offer you our products and services or answer your questions. We will offer access to you for any purpose, including requesting the updating, correction and deletion of data, as long as TNH HEALTH is not required by law or for legitimate business purposes to retain it.
Your personal data can be analyzed and associated with other information that TNH HEALTH has access to, guaranteeing the improvement of our products, services, content and advertising, always respecting this Privacy Policy. TNH HEALTH also reserves the right to collect data that, independently analyzed, does not allow direct association with a specific individual, such as occupation, age, language, postal code, area code, unique device identifier, location and time zone schedule.
Responsibility
Important. The platform developed by TNH HEALTH, when applied for health purposes, serves as an auxiliary tool in the monitoring of treatment and monitoring of patients and does not replace medical diagnoses. The population management and communication automation platform does not replace the health professional / patient relationship. TNH HEALTH does not prescribe medication, does not make a prognosis, diagnosis or remote intervention.
If your data has been forwarded to TNH HEALTH by a Contractor of our services, we understand that this Contractor has already obtained all necessary authorizations for the use of your personal data so that we can provide the contracted services and transfer personal data to third parties who provide ancillary activities and / or complementary.
Disclaimer of Warranties and Warranties. We take the security of your personal data very seriously, that's why we have cryptographic transmission technology on our platform. Our services are provided as is, subject to failures and defects. Considering that no security system is absolutely safe, TNH HEALTH disclaims any responsibility for any damages and / or losses arising from failures, viruses or invasions of the database of its products, services and website, except in cases where it has acted with intent or guilt.
Integrity of the information provided. TNH HEALTH does not commit itself to the veracity of the information provided by its users.
End of use
You can cancel your participation at any time by sending the word STOP to stop receiving text messages via SMS, RCS, Facebook Messenger, Whatsapp, Telegram, or any message platform that TNH interacts with you. If these services are not available, please contact us by contact @ ta-na-hora, inform your cell phone number and request cancellation. The account will be blocked and all information you have already made available on the Site will be removed within 5 (five) business days, however your access records will need to be stored by TNH HEALTH during the legal term, as detailed in our Policy Privacy Policy.
We reserve the right to unilaterally cancel the provision of the Services to you. In this case, we are committed to making your account information available to you. We warn that the use contrary to the law, morals and good customs may result in the immediate blocking of your account, as well as its subsequent cancellation and exclusion.
General Terms
Our Indemnity. You undertake to defend, indemnify and exempt TNH HEALTH, its affiliates, executives and employees from any disputes, claims, losses, damages, lawsuits, judgments, litigation costs and attorney fees arising from the following:
  • Violation of these Terms of Use;
  • Irregular use of the Service;
  • Violation of any government rules, laws, regulations, codes, statutes or regulations; and
  • Violation of TNH HEALTH or third parties' intellectual property, confidentiality, publicity or privacy rights;
Third Party Rights. These Terms govern the relationship between TNH HEALTH and you. Therefore, TNH HEALTH is not responsible for any content made available by third parties through its user.
Changes to the Terms of Use. We reserve the right, at any time, to modify these Terms of Use. Whenever we make any changes, we will notify you by means of a notice on our home page or by electronic correspondence, so that you can access and review the changes made to this document. If you do not agree with any changes, you can stop using TNH HEALTH. If you do not expressly express yourself within 15 (fifteen) days or continue to use the Services regularly after the changes are implemented, your tacit acceptance will be considered.
Absence of Waiver. If you do not comply with these terms and we do not take immediate action, it does not mean that we are waiving any rights that we may have (such as taking future action).
Contract Integrity. If any provision of these Terms is found to be legally invalid, it will not affect the validity and regular application of any other provision, which will continue to bind you and TNH HEALTH.
Conflict and Forum Resolution. We want to have the best possible legal relationship with you and will always try to resolve our conflicts amicably. If this is not possible, these Terms will be governed by Brazilian law, the São Paulo District Court, São Paulo State being elected, with the express waiver of any other, however privileged it may be.

We respect your information
This Privacy Policy concerns the data that TNH Digital Health S / A ("TNH HEALTH") may obtain when you use our Services. In this Privacy Policy, we describe how we collect data about you through our platform ("Platform"), as well as how we can use, store and share them under Law 12.965 / 2014 ("Marco Of the Internet") and Decree 8.771 / 2016. If your data has been forwarded to TNH HEALTH by a Contractor of our services, we understand that this Contractor has already obtained all the necessary authorizations for the use of your personal data so that we can provide the contracted services and transfer personal data to third parties who provide ancillary activities and / or complementary.

Collected Information
Data provided. TNH HEALTH may collect information sent by a Contractor, or voluntarily by Users, including names, social security numbers, email, phone numbers, addresses, among others. In addition, we may collect information from your normal use of our Platform.
Confidential Information. We recognize the sensitive and confidential nature of information obtained through the use of our Platform. We undertake to keep this information of a confidential nature confidential, without using or disclosing it without your authorization, except to the extent necessary for the performance of our contractual obligations and the defense of your and our interests.
Cookies e Web Beacons. We can use standalone tools such as cookies and web beacons to collect information such as your IP address, browser characteristics, details of your operating system, language preferences, websites accessed and duration of access (cookies are small data files transferred from a website to your computer's disk, and do not store personal data).
We have the right to combine this information with information you voluntarily provide. Some browsers allow blocking cookies and web beacons. You can cancel them, but be aware that this can impair the smooth functioning of the Platform.
Our use
We have seven goals when collecting this type of data:

The data recorded on our Platform will be stored in a safe environment and access restricted to you and those with whom you wish to share it, always taking into account the preservation of intimacy, privacy, honor, image and medical confidentiality of the parties directly or indirectly involved.
Other Important Information
International Data Transfer. Your data may be stored outside of Brazil. According to national law, this constitutes "International Data Transfer", so by agreeing to this Privacy Policy, you also consent to this submission. We guarantee that your data will also be protected and well taken care of abroad.
Anonymized data. The data of all users together, unrelated to personal information (which allows the identification of the holder) are called "anonymous data". If / when we use the anonymization process, we can analyze data for statistical and commercial purposes.
Safety. We have tools to protect your personal data from malicious or unauthorized third parties. Sharing your data with third parties. In addition, TNH HEALTH may share this data with third parties and partners in order to provide a better quality service, with better technology and to offer product and service offers.
Use of your data to improve services. TNH HEALTH may use any of your information that has been provided to you by a Contractor, or directly provided by Users, or that TNH HEALTH has in any way captured, to optimize your usage experience, to correct and improve the performance of your Services.
Order of competent authorities. We cooperate with the competent authorities and with third parties to ensure compliance with the laws, safeguard the integrity and security of the Platform and its users, and prevent conduct that undermines the moral integrity and honor of the individuals or companies involved.
We may disclose Personal Information, Access Records, browsing data and Data protected by medical confidentiality only under the terms provided for in Brazilian law. We have the right to disclose information to other users, entities or third parties, if there are sufficient grounds to consider that a user's activity is potentially unlawful or harmful to other people. This right will be used in accordance with Brazilian law, when we consider it appropriate or necessary to maintain the integrity and security of the Platform and users, and to enforce the other policies of the platform.
Data issues. You can at any time review, edit or delete your registration information through the Platform. We count on you to keep your data up to date. If you are unable to make any changes, send an email to contato@tnh.health requesting the change and we will work on it.
Data retention. We commit to deleting your registration after you decide to permanently disconnect from our Services. If you want to remove your account before then, send an email to contato@tnh.health with the subject "Delete my account" and your mobile number. Your account will be deleted along with all your data. Notice: we have a legal obligation to keep your connection records (IP and access times, basically) for six months before deleting them.
